Interview with Steve Bliss on Estate Planning

Hi Steve, thanks for taking time out of your busy schedule today. For our viewers who may not be familiar, can you tell us a little about what probate is and why it’s important?

Steve Bliss:

You’re welcome! Probate is essentially the legal process of administering a deceased person’s estate. It involves identifying and inventorying their assets, paying off debts and taxes, and ultimately distributing the remaining property to heirs or beneficiaries according to the will – if there is one – or state law.

It’s important because it ensures that the deceased person’s wishes are carried out and their assets are handled properly. Without probate, things can get very complicated and messy, potentially leading to disputes among family members.

That sounds like a lot to handle. What would you say is one of the most crucial steps in this process?

Steve Bliss:

I’d say handling debts and taxes is absolutely critical. It’s often a complex and time-consuming part of probate. Ordinarily, we begin by identifying all potential creditors and notifying them of the decedent’s passing.

We then carefully review all financial records to determine which debts are valid and need to be paid. Consequently, it’s essential to have accurate documentation and a thorough understanding of tax laws.

Notwithstanding this complexity, failing to properly address debts and taxes can lead to serious legal and financial consequences for the estate executor or administrator.

Moreover, the IRS has specific guidelines regarding estate taxes that must be followed. For instance, according to a recent report by the Tax Policy Center, only about 0.1% of estates owe federal estate taxes.

Nevertheless, even if the estate doesn’t owe federal taxes, state inheritance or estate taxes may still apply.

Have you ever encountered any specific challenges while handling debts and taxes in probate?

Steve Bliss:

Certainly. I once worked on a case where the decedent had numerous outstanding credit card debts, some of which were disputed by family members. It took considerable time and effort to gather evidence, negotiate with creditors, and ultimately reach a fair resolution.

There was another instance where we discovered significant discrepancies in the decedent’s financial records. This required us to consult with forensic accountants to trace transactions and ensure that all assets were properly accounted for.

Those are certainly complex situations. What advice would you give to someone planning their estate?

Steve Bliss:
