Ted: This stage is crucial because it allows the court to get a comprehensive picture of the situation. A court-appointed investigator, often called a guardian ad litem, will interview the proposed ward, assess their living environment, and gather input from family members, caregivers, and professionals.

They may also order a medical or psychological evaluation to determine decision-making capacity. The investigator then prepares a detailed report for the judge, outlining their findings and recommendations.

Guardianship is a legal process where a court appoints a person (the guardian) to make decisions for another person (the ward) who is unable to do so themselves due to incapacity or disability, whether a child or an adult.

Purpose: Guardianship is used to protect individuals who cannot care for themselves due to infancy, incapacity, or disability.

Court Appointment: A court appoints a guardian, who then has the legal authority to make decisions on behalf of the ward, including decisions about personal care, medical treatment, and financial matters.

Guardian’s Responsibilities: Guardians have a duty to act in the best interests of their ward and to the court.

Guardianship and Conservatorship Defined:
Guardianship – also known in some jurisdictions as conservatorship—is a legal process used when an individual is no longer capable of making or communicating informed decisions about their personal affairs and/or finances. This may be due to cognitive decline, mental illness, developmental disability, or other impairments, and can leave the individual vulnerable to exploitation, fraud, or undue influence.

Because guardianship can significantly restrict a person’s autonomy and decision-making rights, it is generally considered a measure of last resort. Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
