Tell us about the different types of guardianship available in California

California law recognizes a few different types of guardianships, each tailored to meet specific needs. We have Guardianship of the Person, which focuses on making personal decisions for someone who can’t do so themselves like medical care or where they live. Then there’s Guardianship of the Estate, which handles financial matters and assets. Sometimes, a person needs both, resulting in a General or Plenary Guardianship. And for situations requiring more limited support, we have Limited Guardianships. Finally, Temporary or Emergency Guardianships can be put in place quickly when someone needs immediate protection.

Let’s Dive into Step “D” – the Court Investigation and Evaluation

This step is crucial because it ensures a thorough understanding of the situation before guardianship is granted. The court appoints an investigator, sometimes called a guardian ad litem, who acts as an impartial party. They interview the proposed ward, their family members, caregivers, and even professionals involved in their care.

The investigator also reviews living conditions and often requests a medical or psychological evaluation to assess decision-making capacity. Their findings are then presented to the court in a written report. This process helps protect everyone’s interests and ensures guardianship is truly necessary.

Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
