Ensure their children are provided for? Leave a legacy to a favorite charity? Then, we move into gathering detailed financial information – assets, debts, beneficiaries – the whole picture. From there, we choose key people – executors, trustees, guardians – those entrusted with carrying out their wishes. This is where things get personal, and we spend a lot of time discussing who best embodies their values and can handle the responsibility. It’s a team effort, ensuring everyone understands their role.

Following that, we create the core documents – the will, trust if desired, powers of attorney, advance healthcare directives. These are the legal instruments that formalize their intentions. Then comes the funding of the trust, which is transferring assets into the trust’s ownership. Communication is key, making sure the chosen individuals are aware of the plan and where to find the documents. And finally, regular review and updates are crucial, as life changes – marriage, divorce, births, deaths, significant asset changes – all necessitate adjustments. It is a continuous process, not a one-time event.

We emphasize communication with family members. Openly discussing your wishes reduces the chance of confusion or conflict down the road. We’ve seen countless cases where a lack of communication led to probate battles and strained family relationships. The emotional toll can be significant, and it’s something we actively work to prevent. Many clients also appreciate our collaborative approach; we don’t just tell them what to do, we explain the *why* behind each recommendation, ensuring they feel empowered and in control.

One thing that is often overlooked is the importance of organizing and storing your documents. Having everything in a secure yet accessible location—a fireproof safe, or even with your attorney—can save your loved ones a tremendous amount of time and stress when the time comes. We’ve also seen a lot of value in clients creating a simple checklist or summary of their plan, so their family knows where to start. It’s about making things as smooth as possible for them during a difficult time.

Let’s dive a little deeper. If you had to pick one step that clients consistently underestimate, what would it be and why?

I would say it’s ‘H – Organize and Store Your Documents.’ It sounds so simple, but it’s often the last thing on people’s minds. They focus on the legal documents themselves, but don’t think about what happens *after* those documents are signed. We had a client, let’s call him Mr. Abernathy, a retired naval officer, who meticulously crafted a very comprehensive estate plan. He had everything in order, or so he thought. Unfortunately, he was a bit of a packrat, and his important documents were scattered throughout his house, hidden in various boxes and drawers. After his passing, his family spent weeks searching for everything, causing significant stress and delaying the probate process. It was a classic case of good planning undone by poor organization.

Another scenario involved a lovely woman, Mrs. Gable, who had a very detailed estate plan but kept the original documents in a safety deposit box. She didn’t inform anyone about the box or its location. When she passed away, her family couldn’t find the documents for months, and had to go through a lengthy legal process to access the box. It’s a reminder that even the most well-crafted plan is useless if your loved ones can’t find it when they need it. It’s not just about having the documents, it’s about ensuring they are accessible and known. We always advise clients to create a ‘letter of instruction’ – a separate document that outlines the location of key documents, account numbers, and other important information. It was a brilliant solution, but it highlights the importance of planning for the digital age. We encourage clients to regularly back up their digital files and keep their passwords secure. It’s about being proactive and thinking ahead.

About Estate Planning Law – Ted Cook

Ted enjoys working with clients to create a custom estate plan to protect their assets and to make sure their wishes are reflected in their estate plan. He treats each client as an individual and takes pride in the level of service he provides.

Ted graduated from the U.S. Air Force Academy and was commissioned an Ensign in the U.S. Navy. In the Navy, he was a Surface Warfare Officer and served on three ships on the West Coast. While in the Navy, Ted attended the University of San Diego School of Law where he received his Juris Doctrate degree in 1989. After law school, Ted continued his active duty service in the Navy as a Judge Advocate General Corps officer. After retiring from the Navy in 2011, Ted became a partner with Tom Henry in the law firm of Henry & Cook, LLP focusing on estate planning. Upon the passing of Tom Henry in 2022, Ted started his own firm and continues to help his clients create estate plans that are individually tailored to meet their needs.
